Terms & Conditions
1. PRODUCTS
1.1 Where any products sold by us come with a manufacturer’s guarantee we will try to pass on to you the benefit of such guarantee. Any such guarantee is in addition to, and does not affect, your legal rights in relation to any products that are faulty or not as described.
1.2 If you are unhappy with any products you buy from us (excluding hair pieces and wigs) for any reason or you change your mind, you may return them to us at your own cost within 14 calendar days of purchase and we will refund you the price you paid for such products. This guarantee is in addition to, and does not affect, your legal rights in relation to any products that are faulty or not as described.
1.3 Subject to your rights to change your mind (see below), we do not offer exchanges on hair pieces or wigs. We’re happy to issue refunds on all our hair pieces and wigs except where a colour or cutting service was chosen, (custom colour, shorten length, add fringe/bangs/face-frame cut/layers etc) or an adjustment was made to the base (remove clips/replace wig comb etc). You must notify us if your change of mind within 14 days of receipt of the goods by you and must return them within 14 days.
To receive a refund, the piece must not be altered in any way. You must return the topper in the exact same condition as it was received. This includes: (but not limited to) washing, cutting, changing the part, use of heat tools, use of hair products or dyes. Do not alter the base in any way. Do not remove or alter the position of the clips or wig comb. Do not fold the topper in half when returning, ensure to layer flat intact in protective packaging with all clips closed.
The customer is responsible for any return postage and a trackable service is strongly recommended to ensure that the package arrives safely. Hair Story cannot be responsible for any returns that go missing. The customer will be required to open a claim with the shipping courier for their loss should a package go missing.
2. TREATMENTS
2.1 We will perform all treatments with reasonable skill and care and will make every effort to perform the Treatments on time. However, there may be delays due to an event beyond our reasonable control and we will not have any liability in such event other than to offer an alternative treatment time or full refund.
2.2 Prior to undergoing any treatment, you may be required to complete a Health Consultation Form. The purpose of completing the form is to enable us to identify any allergies or medical conditions that you may have and to determine what treatments may or may not be suitable for you. If at any time during your membership any information previously provided becomes inaccurate you must inform us as soon as reasonably practicable and in any event before you have any further treatments.
2.3 We reserve the right to refuse to carry out or complete a treatment if it becomes apparent prior to or during a treatment that you have any medical condition or allergy or similar condition that may put you at risk if you were to undergo the treatment. We will not be liable to you for any loss in connection with any such cancellation.
2.4 Whilst in attendance at our premises you must comply with our Behaviour Policy, a copy of which is available upon request and copies are also displayed in our premises.
2.5 In the unlikely event that there is any problem with any treatments we have provided please contact us and tell us as soon as reasonably possible.
2.6 Gift vouchers for package treatments will convert to the equivalent monetary value (at time of purchase) upon expiry and will only be honoured at the discretion of the Company.
Gift vouchers for package treatments which are no longer available will be converted to the equivalent monetary value of the original package treatment (at time of purchase) until expiry.
All gift vouchers used as payment will serve as a deposit on booking. Non-attendance and cancellation policy is applicable and any non-attendance or cancellation fees may be redeemed against the value of the gift voucher at the Company’s discretion.
3. NON-ATTENDANCE AND CANCELLATION
3.1 To place a booking, all services require 50% of the full price as a booking fee. Booking fees are non-refundable. Should you wish to cancel or rearrange your appointment the booking fee will be added to your account as credit.
3.2 If you do not attend a booked appointment without letting us know in advance then you will still be responsible for the full price of the treatment.
3.2 You have the following rights to cancel a booking for services, including where you choose to cancel because we are affected by an event beyond our reasonable control:
· subject to the cancellation charges set out below, you may cancel any booking for treatments at any time prior to the booking;
· if you cancel a booking and you have made any payment in advance for services that have not been provided to you, we will refund the relevant amounts.
3.3 If you cancel a booking for a treatment you will be responsible for the following cancellation fee:
· where the cancellation is more than 48 hours before the booked time for the service, there will be no cancellation fee.
· where the cancellation is 48 hours or less before the booked time for the treatment, your booking fee is not transferable and will be lost.
3.4 If we have to cancel a booking due to an event beyond our reasonable control or the unavailability of key personnel or key materials without which we cannot provide the services we will promptly contact you to let you know and if you have made any payment in advance for the services, we will refund these amounts to you.
4. OUR LIABILITY TO YOU
4.1 As a consumer, you have legal rights in relation to treatments not carried out with reasonable skill and care, or if any products we use are faulty or not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these terms and conditions will affect these legal rights.
4.2 We only supply products and/or treatments for private use. You agree not to use the products and/or treatments for any commercial, business or re-sale purpose, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
4.3 We do not exclude or limit in any way our liability for:
· death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors;
· fraud or fraudulent misrepresentation;
· breach of the terms implied by section 12 of the Sale of Goods Act 1979 and by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession);
· breach of the terms implied by sections 13, 14 and 15 of the Sale of Goods Act 1979 and sections 3, 4 and 5 of the Supply of Goods and Services Act 1982 (description, satisfactory quality, fitness for purpose and samples); or
· defective products under the Consumer Protection Act 1987.
4.4 We will not have any liability to you if loss, injury or damage occurs as a result of a failure to provide information or as a result of the supply of inaccurate or incomplete information on a Health Consultation Form or otherwise.
5. YOUR PERSONAL INFORMATION
Where you have given us any personal information, we only use such personal information in accordance with our Privacy Policy. Please take the time to read our Privacy Policy), as it includes important terms which apply to you.
